1. What data do we collect from you, for what purposes and on what legal basis? Contacting us If you contact us by means of a form on the website or by email, the personal data provided by you (name, email address, company and message content) will be collected and processed. These data are processed, stored and used exclusively for the purpose of answering your request or for establishing contact with you and the associated technical processing or administration. This data processing is therefore necessary to fulfill our (pre-) contractual interests.
Comments function on our blog In addition to your comment, information on the time of writing your comment and the name you have provided for commenting will be saved and published on the website as part of the comments function on the blog of this website. Furthermore, your email address will be logged and saved. The email address will not be published on the website. We need your email address in order to contact you if a third party objects to your published content as unlawful. The processing of personal data is thus based on our legitimate interests in the provision of a (secure) commentary on our blog. We reserve the right to delete comments if they are objected to by third parties as unlawful.
Server log files
When you use our website, we only collect such data that your browser reports to our server (so-called “server log files”). When you visit our website, we collect the following server log files, which are technically necessary for us to display the website: our visited website, date and time at the time of access, amount of data sent in bytes, source / reference, from which you came to the page, browser used, operating system used, IP address used (possibly in anonymous form). This processing of server log files is based on our legitimate interest in providing the website, improving the stability and functionality of our website.
Feedback and Surveys
If you leave us feedback on our services or participate in surveys on our website, we will process the personal information that you provide voluntarily (the email address and the content of your feedback or answers as part of the survey). A. Information You Provide as a User When you register an account as a User, you may be asked to provide Personal Data including without limitation, your name, phone number, email address, home address or business address. You may also choose to submit Personal Data to us when you send us an email or use any interactive features that we may make available on the Service. For example, you may ask us to: (a) import your contacts by giving us access to your third party services (such as your email account) or (b) use your social networking information if you give us access to your account on social network connection services. You may also provide us with your contacts’ email addresses when sharing folders or files with them or if you invite them to join DocSend. In addition, if you sign up for our paid Service, you may be asked to provide additional information, including your credit card information, as described below.
B. Events We may also collect data from you including without limitation when you attend one of our events, during phone calls with sales representatives, or when you contact customer support.
C. Employment Applications When you apply for employment through the Site, our provider of recruiting services will collect your resume and any additional information that you elect to provide to us, including but not limited to your employment history and education. In addition, where permitted by law, we may use a third party to carry out a background check to determine your suitability for a position.
D. Information We Receive from Viewers If you are a Viewer, a User may request that you provide them with information (including Personal Data) via the Service in order to view that User’s Content. In particular, in order to access Content that a User wants to share with Viewers, a Viewer may be asked to provide his or her email address upon opening a DocSend User’s link (or Viewers’ email address may be provided by the User). DocSend stores this information on behalf of our Users. In the event you as a Viewer provide a User with this information, you do so in accordance with that User’s privacy practices and policies. DocSend is not responsible for the privacy practices of its Users, and does not access this information except with a User’s permission, in order to provide the Service and related support and assistance. If you are a Viewer of one of DocSend’s Users and would no longer like to be contacted by such User that uses DocSend’s Service, please contact the User that you interact with directly.
E. Content In providing the Service, we process on behalf of Users information included in the Content that Users (and as appropriate Users’ representatives, employees or other data subjects as elected by Users) upload, download, or access with, share, or send through the Service (“Content”). If you add Content to your account that has been previously uploaded by you or another user, we may associate all or a portion of the previous Content with your account rather than storing a duplicate.
F. Information We Receive from Third Parties We may also receive Personal Data (such as your email address) through other Users, for example if they have tried to share something with you or tried to refer DocSend to you. We may supplement the information that we collected from Users and Viewers (such as an email address) with additional information obtained from publicly available and third-party databases or services that provide information about business people and companies (including an individual’s name, job title, business contact information, and company information), and display this information to our Users as a part of our Services.
Social Media Sharing We offer the possibility to share blog articles of our website on social media like Facebook, Twitter, LinkedIn and Google+. In order to increase the protection of your data when visiting our website, these buttons are only embedded in the page by means of an HTML link and not fully integrated. This ensures that when you visit a page on our site that contains such buttons, it will not automatically connect to the Facebook, Twitter, LinkedIn, or Google+ servers. If you click the button, a new browser window will open and call up the Facebook, Twitter, LinkedIn or Google+ page, where you can interact with the plugins there (if necessary after entering your login data). Embedded services and third party content We use third-party services and content within our online offering based on our legitimate interests in the provision, optimization and economic operation of our online offerings to integrate their content and services. This usually requires that the respective third-party providers of this content receive the IP address of the users, as they would not be able to send the requested content to their correct browser without the IP address. The IP address is therefore required for the presentation of this content and the use of the incorporated services.
Disclosure of personal data to third parties We share your personal information to the extent necessary withthe following external service providers (processors) who assist us in the provision of our services: IT service providers and / or providers of data hosting solutions or similar services; other service providers, suppliers of tools and software solutions who also support us in the provision of our services and act on our behalf (including providers of marketing tools). All our processors process your data only on our behalf and on the basis of our instructions, so that we can make our online offer available to you. In addition, we will transmit your personal data to the extent necessary to the following recipients (responsible persons): any third parties involved in the provision of services to you to fulfill our contractual obligations; external third parties to the extent necessary on the basis of our legitimate interests (for example, auditors and tax consultants, insurances in the event of a claim, legal representatives if required); authorities and other public bodies to the extent required by law (such as tax authorities). Storage duration We only store your personal information for as long as it is necessary for the purposes for which it is processed. In addition, we might be obliged to keep your data for a longer period of time due to applicable statutory retention periods. Specifically, we store your data in connection with contacting us on the basis of corresponding statutory retention requirements for a period of generally seven years, insofar as they are no longer of use to us. Access data and log files are stored for a maximum of 14 days and then deleted. As a rule, we store data on your user behavior for a period of three years, or at the latest until you revoke your consent. Personal data provided by you as part of feedback and surveys will remain stored until deleted by you or us. If you have only registered for our newsletter and are not a customer of ours, we store your data until you revoke your consent and apart from that up to a maximum of three years. In addition, we store your personal data beyond the specified periods if necessary, as long as legal claims can be asserted from the relationship between you and us or until the final clarification of a specific incident or legal dispute. This longer retention is essential for the protection of our legitimate interests in the assertion, investigation and defense of legal claims.

You may also revoke your consent to the processing of personal data with effect for the future if processing is based on your consent. You may also be entitled to restrict the processing of your data, to object to it, and to the right to receive the data you provided in a structured, common and machine-readable format (“data portability”).
